Minutes of the Extraordinary Parish Council Meeting held at the Mevagissey Activity Centre
On Thursday 30th April 2015 at 7pm.

2a. Declarations of interest. Cllrs. J Barron and T Barron declared an interest in Item 5e.
2b. Gift Declarations. None.
- Points from the Public. Messrs Martin Hopkinson, John Rackun and Pietro Abate spoke in objection to Item 5e, and Mr Michael Curie spoke in objection to Item 5d.
- The minutes of the meeting held on 16 April 2015.
Proposed by Cllr. Arthur, Seconded by Cllr. Hrydziuszka that the Minutes be Accepted. Carried.
- Planning.
5a. PA15/02984 : New three bedroom dwelling to replace existing disused squash court with onsite parking space for three vehicles in adjacent car port (Resubmission of PA14/08061). Land North Of 41 Tregoney Hill Mevagissey.
Proposed by Cllr. Daniel, Seconded by Cllr. Shephard that the Council Supports the proposal. Carried.
5b. PA15/02877 : Extension and alterations. Auraville Trevarth Mevagissey Cornwall PL26 6RX.
Proposed by Cllr. Facey, Seconded by Cllr. Daniel that the Council Supports the proposal. Carried.
5c. PA15/03545 : Construction of summerhouse/home office in rear garden. 57 Portmellon Park Mevagissey St Austell Cornwall PL26 6XD. Cllr. Daniel stated that this site was within a designated Area of Special Character and that the proposal would therefore be in breach of Saved Policy 35 of the Restormel Local Plan. Cllr. Shephard stated that the provisions of Policy 35 would be captured in the Neighbourhood Plan currently under development. Cllr. Whatty stated that Policy 35 now carries little weight with the Planning Authority. Proposed by Cllr. Shephard, Seconded by Cllr. Morgan that the Ward Member asks the Planning Authority to defer a decision on this until the outcome of the Steep House Appeal, seen as a test of the weight of Policy 35, is known. Carried.
5d. PA15/03296 : Demolition and replacement of existing dwelling. Centernhay Cottage 1 Tregoney Court Mevagissey Cornwall PL26 6RN. Proposed by Cllr. Daniel, Seconded by Cllr. Arthur that the Council Objects to the proposal because the increased size and inappropriate design of the proposed replacement building would impact negatively on both the historic setting and the amenity of neighbouring properties. Carried.
5e. PA15/03079 : Proposed Residential Development for 12 New Dwellings (7 Affordable and 5 Open Market).
Land North Of Moonfleet School Hill Mevagissey Cornwall. Proposed by Cllr.Shephard, Seconded by Cllr. Roberts that the Council Objects to the proposal because 1) it does not conform with government planning guidance; 2) it is outside the development envelope; 3) it is a development within the AONB in contravention of Policy 23 of the Cornwall Local Plan; 4) it does not reflect community opinion as reflected in the community survey undertaken this year for the developing Neighbourhood Development Plan, in which 87{c8c3b3d140ed11cb7662417ff7b2dc686ffa9c2daf0848ac14f76e68f36d0c20} of respondents agreed that it was ‘very important’ to protect the undeveloped coastline of the Parish; 5) alternative sites for affordable homes have been identified on the basis of least environmental impact and lowest public amenity value; 6) the Neighbourhood Development Plan (currently in Draft form) would preclude further development in this location by providing greater protection for coastal areas, identifying alternative sites for affordable homes, and retaining the existing development envelope; 7) the view along School Hill provides a ‘public visual amenity’, with the applicant’s own landscape survey accepting that “The location provides a strong visual amenity and far reaching views of the AONB and coastline” and the development “would be a dominant new feature”; 8) increased danger from traffic; 9) a precedent would be set for further ribbon development along School Hill; 10) the buildings proposed are two storey, while the existing dwellings across the road are restricted to single storey; and that these considerations, together with supporting evidence, should form the basis of the Council’s response to the Planning Authority. The following applications have been Approved (included for information only):
5f PA14/11088 : Refurbishment and extension. 29 The Cliff Mevagissey St. Austell PL26 6QT
5g. PA15/01359 : Two storey extension to side elevation of existing Bed and Breakfast and creation of new opening onto highway. Valley House Valley Road Mevagissey Cornwall PL26 6RZ
5h. Additional Item: PA15/01969 : Demolition of existing bungalow and construction of new dwelling. Tresleigh Polkirt Hill Mevagissey Cornwall PL26 6UX. The Planning Authority is minded to recommend Approval and, in light of this Council’s previous Objection, has invoked the ‘5 day protocol’. Proposed by Cllr. Facey, Seconded by Cllr. Daniel, that the Council maintains its Objection and the Application should therefore be called in to Committee.
Carried.
5i. The Chairman, who, along with Cllrs. Facey and Shephard, had attended a Performance Planning Agreement meeting to progress the proposed Tall Trees development, reported that the proposed solution was likely to be acceptable to the Council and that this had shown the benefit of constructive collaboration with the developers.
5j. The Chairman asked members whether they wished to show support for St Ewe Parish Council’s opposition to the proposed Levalsa wind turbine. The consensus was that they did.
- The Chairman reported that those members who had accepted the invitation from the Primary School had found the occasion informative and very enjoyable. The School was clearly very well run, pupil numbers were increasing, and the grant from the Council had been put to good use.
- The meeting ended at 8.20pm.

6.30pm : Annual Parish Meeting, followed by AGM.
7pm : Monthly meeting of the Parish Council (start time may be delayed)
