Minutes of the Parish Council Meeting held at the Mevagissey Activity Centre

On Thursday 18 July 2019 at 7pm

 

Present              Cllrs. M Roberts (Chairman), J Blackmore, J Daniel, M Facey, N Florence, J Gann, L Hereward,

G Shephard, P Simpson, J Whatty.

 

In Attendance      Cllr. J Mustoe (Ward Member), P Howson (Clerk), 1 member of the public.

1a.        Apologies were received from Cllrs. T Barron, J Morgan and H Nathan.

Cllr Facey would be arriving late and Cllr. Mustoe had to leave early.

 

1b.        The Chairman referred to the 15 July visit of the Duke and Duchess of Cornwall, a wonderful day which showed off the village in a very good light and which was clearly enjoyed by the royal visitors. He read out a letter from CC’s Democratic Team Leader (Regulatory) which thanked all involved for their hard work.

 

  1. There were no Declarations of Interest or Gifts.

 

  1. No members of the public wished to speak.

 

  1. Proposed by Cllr. Daniel, Seconded by Cllr. Shephard that the minutes of the meeting held on 20 June 2019 be accepted.                                                                                                                                    Carried.

 

  1. The Clerk reported that:
  • The police website shows 5 crimes reported in May as follows: 2 x public order (School Hill and Lower Well Park, both under investigation); 2 x violence and sexual offences (Portmellon car park, under investigation, and Jetty          Street, unable to prosecute suspect); 1 x anti-social behaviour (Portmellon car park);
  • The broken stile at the junction of the SWCP and the spur leading to Portgiskey has been removed and replaced by a fence which is an obstruction. The spur is not on the definitive list of PROW but a right of way has been established            by many years of use by the public and it is on our contractor’s cutting list. The Countryside Access Team is       talking to the landowner about replacing the stile, and this will be monitored;
  • The Three Bays Wildlife Group conveyed their thanks to the Council for their grant towards the Portmellon Bioblitz;
  • He had received details of Cornwall Community Flood Forum training in September, which Cllr. Facey has forwarded to flood wardens;
  • CC are offering free training for local councillors and clerks to use a new enforcement tool for tackling littering, fly tipping and dog fouling. It comprises a report card which can be completed and returned, like a witness statement,   and sets out what information is needed for the CC team to take enforcement action.

 

  1. The Ward Member presented his report including that:
  • He arranged for the guttering to be cleared in Meadow Street and Wesley Court flats, for the Wesley Court communal waste area to be enclosed to prevent fly tipping, and the double yellow lines in Wesley Court to be repainted;
  • Pentewan Valley Parish Council are proposing to plant wildflowers along the B3273 as wildlife habitats and he wondered if Mevagissey Parish Council would be interested in something similar;
  • He gave the Council a supply of ‘no dog fouling’ stickers to display as members saw fit;
  • He hosted the Royal Visit on 15 July by the Duke and Duchess of Cornwall and thanked all who had participated.

  1. To consider Planning Applications.

 

7a.        PA19/05283 : Variation of Condition 2: to seek a variation to the design of the roof as approved under Decision Ref: PA15/10218 Date of Decision: 31/03/2016. 2 Church Lane Mevagissey Cornwall PL26 6SX

Proposed by Cllr. Shephard, Seconded by Cllr. Gann that the Council supports the application on condition that there is no further demolition of the host building.                                                                                            Carried.

 

7b.        PA19/05282 : Variation of Condition 2: to seek a variation to the repair of the outbuilding as approved under Decision Ref: PA15/10218 Date of Decision: 31/03/2016. 2 Church Lane Mevagissey Cornwall PL26 6SX

Proposed by Cllr. Shephard, Seconded by Cllr. Simpson that the Council supports the application on condition that the damaged wall of Lawn House is made good by the applicant and that there is no further demolition of the host building.                                                                                                                                        Carried.

7c.        PA19/05486 : Proposed Bedroom and ensuite extension with linking bridge to patio. 14 Summerfield Close Mevagissey PL26 6QD.

Proposed by Cllr. Daniel, Seconded by Cllr. Florence that the Council has no objection.                         Carried.

 

7d.        PA19/05419 : Non Material Amendment to Infill approved terrace to extend middle floor level with extended slate roof slope to cover it and addition of small conservatory. (PA18/11627 dated 13/03/2019). Land East Of 5A Church Lane School Hill Mevagissey Cornwall PL26 6TQ       Proposed by Cllr. Facey, Seconded by Cllr. Florence that the Council has no objection to the proposal. However, because this is not a non-material amendment, we would like an assurance that neighbours have been given proper notice of the changes, site notices have been posted, etc.         Carried.

 

7e.        PA19/05471 : Proposed alterations and associated improvements to the lower ground floor rear elevation of 14 Polkirt Hill. The Old Net Loft West Wharf Mevagissey PL26 6UJ

Proposed by Cllr. Florence, Seconded by Cllr. Daniel that the Council has no objection to the application subject to the views of the Conservation Officer.                                                                                             Carried.

 

7f.         PA19/05472 : Listed Building Consent for the proposed alterations and associated improvements to the lower ground floor rear elevation of No.14 Polkirt Hill. The Old Net Loft West Wharf Mevagissey PL26 6UJ

Proposed by Cllr. Florence, Seconded by Cllr. Daniel that the Council has no objection to the application subject to the views of the Conservation Officer.                                                                                             Carried.

 

7g.        PA19/05123 : Demolition of existing dwelling and construction of a new dwelling with garage incorporating self contained studio flat over. Come-By-Chance Trevarth Mevagissey PL26 6RX

Proposed by Cllr. Shephard, Seconded by Cllr. Facey that the Council has no objection to the proposal provided that the additional self-contained accommodation is restricted to permanent occupancy as a principal residence. NDP Policy HO1 does not support the use of new-builds as holiday accommodation.                                               Carried.

 

7h.        PA19/05311 : Submission of details to discharge conditions 5, 8 and 9 in respect of decision notice PA18/08553. Land Adjacent 38 Kiln Close Mevagissey PL26 6TP              (Not a consultation)

Proposed by Cllr. Shephard, Seconded by Cllr. Gann that the Council is unable to assess the visual impact of the proposed gabion retaining walls from the limited information provided, and requests that elevations and artists impressions are provided for this purpose. Until this is resolved the Council OBJECTS to the application.      Carried.

 

7i.        An Appeal against Refusal has been made for the following: PA18/07894 : Removal of self contained annexe and    erection of a new dwellinghouse with associated parking. Sunny Croft, Ava (for information). Proposed by Cllr.          Shephard, Seconded by Cllr. Gann that the Council makes a further submission to the Appeal Inspector.    Carried.

 

7j.        The Chairman reported that the recent meeting with the Local Planning Area Group Leader was generally positive,   and asked the Clerk to obtain an update on the agreed actions.

 

7k.        The Chairman reported on the recent meeting with Ocean/G&G regarding PA18/09651 (Vicarage Hill), and asked    the Clerk to chase up the proposed meeting with CC Highways and to clarify with the Affordable Housing Unit the issues surrounding the criteria proposed by Ocean for rented and shared ownership houses.

 

7l(i).     The Clerk reported that planning enforcement case EN19/00832 (Steep House, Portmellon) was now at Step 6, ie    working to find appropriate outcome such as: Regularise with application; Negotiate remedial works; Negotiate            removal of unauthorised works.

7l(ii).    Proposed by Cllr. Gann, Seconded by Cllr. Facey that a breach of planning be reported regarding new ground based             solar panels on Battery Terrace.                                                                                                      Carried.

 

7m.       The following planning decisions have been received (included for information only):

 

PA19/04218 : New detached garage. Hunrosa House, 20 Portmellon Park.                                APPROVED

PA19/04862 : Removal of storage building to rear, construction of two storey extension with mono pitch roof and   single storey flat roof extensions to the rear of the property. Christabel, Beach Road.               APPROVED

PA19/01977 : Proposed cross-subsidy residential development comprising 7 dwellings (4 affordable), access and      landscaping. The proposals include associated driveways, car parking and private gardens. It was noted that the last item on the list of bills to be paid had been added since the agenda was published.

Proposed by Cllr. Facey, Seconded by Cllr. Hereward that the accounts be accepted and the bills paid.       Carried.

 

  1. Cllr. Gann reported that his meeting with CC’s Rural Housing Enabler had been postponed, and a possible site had emerged for development by a Community Land Trust.

 

  1. Cllr. Facey summarised the vandalism that had occurred in the public conveniences during Feast Week; and recommended acceptance of the proposal by Gary Farr, who cleans and maintains the facilities, to deploy on-site attendants at West Wharf during the afternoons of the holiday period. Proposed by Cllr. Whatty, Seconded by Cllr. Gann that on-site attendance between 12-4pm during the 6-week period starting 22 July be authorised. Carried.

  1. The Council agreed to defer to Cllr. Facey’s recommendation that murals should not be painted on the toilet blocks.

 

  1. The Chairman confirmed that the 24/7 defibrillator would be installed on the quay by the end of the month.

 

  1. Cllr. Shephard asked what members thought about declaring a climate emergency once CC’s awaited paper on the subject was published later this month, and it was agreed that the Council is generally open to the idea.

 

  1. It was agreed that the Council should respond to CC’s consultation on the Planning for Coastal Change Chief Officer Planning Advice Note, highlighting that the document neither recognises nor serves the needs of Cornish coastal settlements like Mevagissey.

 

  1. To consider a response to CC’s consultation on Street Trading Policy. Deferred to next month.
