St Just in Roseland Parish Council Minutes – December 2015

Minutes of the Meeting of St Just in Roseland Parish Council held in the Millennium Rooms,

St. Mawes, on Monday 2nd November 2015. The meeting commenced at 7.00pm.

 

Councillors Present:

The Chairman Cllr. B. Chenoweth, J. Benney, S. Black, P. Farmiloe, R. Giles, R. Hall, B. Sadler, P. Salter, P. Teague, K. Warren, C. Williams and Cornwall Cllr. J. German

 

Also Present:

  1. Penhaligon (Clerk), S. Chenoweth (Assistant Clerk) and 1 Member of the public.

 

The Chairman asked for a minutes silence to remember ex Councillor Brenda Pye who passed away last week. Miss Pye joined the Council in June 1995, stepping down in 2003 and was the Chairman in 1997/98.

  1. Confirmation of the minutes of the Parish Council Meeting held on Monday 5th October 2015

The Council RESOLVED, by a show of hands by those who had attended the said meeting, that the minutes of the 5th October 2015 meeting be approved and they were duly signed by the Chairman. 3 abstained.

 

  1. Matters arising from the Minutes not on the Agenda
  2. a) Improvements to signage and traffic control measures in St. Mawes/On-street parking enforcement

Nothing new to report.

 

  1. b) Carols in the Castle – 19th December 2015

All arrangements are in hand. The risk assessments are complete and English Heritage have confirmed.

 

  1. Report from the Clerk – No report given.

 

  1. Report from Devon and Cornwall Constabulary

During September the Police were called to the Parish 13 times. No crimes were recorded.

 

It was noted that PC Neil Duckworth retired in October from the local Neighbourhood Police Beat. On behalf of the Parish Council, the Clerk sent good wishes and thanks for his help in the community.

 

  1. Report from Cornwall Cllr. German

Cornwall Cllr. German reported that the Roseland Community Transport car scheme has made 23 journeys with all trips being for medical purposes.

 

  1. Report from Councillors as representatives of other Committees

St Just and St. Mawes Heritage Group – Cllr. Williams reported that the group will be holding a St. Mawes Day in celebration of the village Saint, on 18th November at the Holy Well and in the Millennium Rooms.

 

St Just Institute – Cllr. Teague reported that the Defibrillator training session with input from S. Miles, R. Mitchell and S Pearce was incredibly helpful, extremely interesting also exceptionally well attended.

 10a. Accounts and Finance

  1. i) To approve the payments of accounts (Appendix 1)

The Council was asked to approve the following payments:

Approval of the payments of accounts proposed by Cllr. Sadler. Seconded by Cllr. Hall. All in favour by a show of hands. RESOLVED by the Council.

 

  1. ii) To consider a donation for the Remembrance Sunday wreath under Section 137 of the Local Government Act 1972

Cllr. Salter proposed a donation of £120 to the Earl Haig Fund to include the Parish Council’s wreath. Seconded by Cllr. Giles. All in favour by a show of hands. RESOLVED by the Council.

 

iii) To consider a donation to the Harbour Lights Committee in lieu of storage under Section 145 of the Local Government Act 1972

Cllr. Williams proposed a donation of £350, the annual cost of the storage, in view of the benefit the display of lights gives to the whole community. Seconded by Cllr. Giles. All in favour by a show of hands. RESOLVED by the Council.

 

10b. Finance Committee

To consider the report and recommendations from the Finance Committee meeting held on 29th October 2015 (Appendix 3)

Cllr. Hall, Chairman of the Finance Committee reported on:

(6) The Three Year Budget – the document takes into account the 2015/16 forecast, including £30,000 on car park maintenance and £7,000 on solar panels and showed a carried forward reserve of £27,661. When using similar forecast figures for 2016/17 and 2017/18 the figures more or less break even with the reserve carried forward of about £28,000. This is a working tool and will be reviewed at the next finance meeting.

 

(8) Solar Panels – the Finance Committee considered the three quotations received and approved the quotation from Cornwall Solar Panels for 12 x Sunpower 327 (4kwp) with a 25 year guarantee, at a net cost of £7,327.08 subject to completion before the end of December.

 

Cllr. Salter proposed to approve the quotation by Cornwall Solar Panels at a net cost of £7,327.08. Seconded by Cllr. Farmiloe. All in favour by a show of hands. RESOLVED by the Council.

 

(9) Heating in the Millennium Function Room – The decision to install alternative more efficient/effective heating was delayed as quotations have not been submitted. The deadline to apply for a grant from Western Power Distribution is 10th November and time is getting short for the Finance Committee to consider them.

 

(11) St Mawes Recreation Ground – the Finance Committee approved the payment of the annual insurance premium as the Recreation Ground is a valued asset of the community and the land is registered in the Parish Council’s name.

 

Cllr. Giles proposed to approve the funding of £2,326.40 as a donation to the St Mawes Recreation Ground for its annual insurance premium to Zurich Municipal under section 19 of the Local Government Act 1972. Seconded by Cllr. Hall. All in favour by a show of hands. RESOLVED by the Council.

 

11a. Planning

  1. a) To consider recommendations from any meeting of the Planning Committee held on 26th October 2015 (Appendix 3)

The Planning Committee considered planning application PA15/08711 – Lowen Meadow, Newton Road, St Mawes (28) – Certificate of Lawfulness for the continued use of land for setting down and taking off of helicopters. The application was opposed by the Planning Committee as the factual grounds presented were incorrect and cannot be relied upon as shown by the evidence brought forward from the general public.

 

Cllr. Benney who had declared an interest left the meeting when the vote was taken.

 

The Parish Council agreed to investigate why enforcements have not been followed through over the past

two years regarding change of use of the field, safety issues and the number of landings.

 

  1. b) The Council considered the following planning applications:
  2. PA15/07032 – Riviera Gardens, Riviera Lane, St Mawes – alterations and extensions to the existing dwelling –the Planning Committee agreed to disagree under the 5 day rule with the condition to ensure that a Construction Method Statement has been approved in by the LPA

 

  1. PA15/08471 – Rose da Mar, St Just in Roseland – New external door to replace existing

       picture window, access balcony and steps – considered by Cllrs Teague, Benney and Giles (Cllr.

Warren declared an interest) – no objection

 

  1. PA15/08737 – Penolva, Lower Castle Road, St Mawes – Proposed conversion of part of

detached garage to annexe with juliette balcony on South East elevation, to provide ancillary accommodation to main house – considered by Cllrs Benney, Farmiloe and Giles – no objection on condition that the annexe is retained as part of the main residence

 

  1. PA15/08953 – Primrose Hill, Freshwater Lane, St Mawes – various alterations to dwelling, including external slate cladding at first floor, replacement porch extension and enlargement of two existing first floor openings to provide juliette balconies –considered by Cllrs. Benney, Farmiloe and Giles – no objection

 

  1. PA15/09268 – Nearwater, Polvarth Road, St Mawes – proposed single storey rear extension – under consideration by Cllr. Benney, Farmiloe and Chenoweth – no objection

 

  1. PA15/08827 – Land adj. to Greenwaters, Freshwater Lane, St Mawes – erection of dwelling and garage/boathouse – Cllr. Warren proposed to offer no objection in principle to the development of this site, but, in the light of the changing policy context, approval could only be given if the application complies with the policies of the Roseland Neighbourhood Plan. Of particular relevance to this application is policy H04. Seconded by Cllr. Sadler. 1 abstention. 10 votes in favour. RESOLVED by the Council.

 

  1. PA15/09334 – Deep Dene, Penruan Lane, St Mawes – extension and erection of glazed covered area over balcony and swimming pool in garden – considered by the planning committee – no objection to the proposed application as presented on condition that the level of glazing is acceptable and that the applicant is not exceeding their Permitted Development Rights.

 

  1. PA15/09338 – building plot adj to Angarrick House, Chapel close, St Just in Roseland

proposed revised scheme of approved dwelling – It was noted that there were some positive elements to the new plan. Cllr. Giles proposed to object to the new application as it does not conform to the Roseland Plan Policies GP2 (iii), LA1 (i) and (ii), CV1 (i) and HO4 as it is not in keeping other properties nearby with regard to design, character, the street scene and landscaping. Neither is it affordable led. Seconded by Cllr. Benney. 2 abstentions. 9 votes in favour. RESOLVED by the Council

 

  1. PA15/09802 – Little Polvarth, Polvarth Road, St Mawes – amended roof area to day room from previous approved application PA15/02800 – considered by Cllrs. Benney, Chenoweth and Salter – no objection

 

  1. PA15/09519 – Bosloggas, St Mawes – Western Power Distribution (WPD) has been asked to provide an electricity connection to the above new Building. WPD have a statutory duty to provide connections to the electricity network and in order to do this it will be necessary to construct approximately 200m length of overhead line supported by 2 single leg wooden poles and one H Wooden pole with a maximum height of 12m and then connected to an underground cable to the ground mounted transformer as shown on the attached plan reference 1793018

 

 

  1. PA15/10003 – 3 Waterloo Close, St Mawes – proposed first floor extension, porch extensions and alterations to fenestration – under consideration by Cllr. Chenoweth, Benney and Salter.

 

  1. PA15/09847 – Sunnybanks, Trelawney Road, St Mawes – proposed first floor extension to create bedroom and ensuite and construction of balcony – under consideration by Cllr. Chenoweth, Giles and Salter

 

  1. PA15/09625 – Cove Cottage, the Square, St Mawes – replacement of an existing 1st floor Juliet balcony with a wider more practical stand out/on balcony to suit opening of bi-fold doors which are 2820 wide. This is to the 1st floor (top floor) of a 1960’s cottage which has a flat roof (and is therefore the floor immediately under the flat roof – the accommodation is reverse level, with the living accommodation on the first floor i.e. upstairs) – under consideration by Benney, Chenoweth and Farmiloe

  1. f) Street Trading

(i) To consider the consultation on Cornwall Council Street Trading Review

Mr Harrison has advised that he wishes to start trading again next Easter. Viv Bidgood, Highways Manager has suggested waiting for the outcome of the new Trading Policy before making a decision. Members of the Council generally felt that the trading stall did not enhance the impression of the setting in an AONB and Conservation Area and there was evidence that Mr Harrison did not keep to the confines the site permitted by Cornwall Council. The Clerk’s Office received three formal complaints. The Council agreed that the Clerk should communicate the Council’s concerns with the Highways Manager. It was agreed that that any signage for trading on beaches or highway in AONB and Conservation Areas must be professional.

 

A local house owner has advised that, in the Trading Review, he will be proposing that certain streets in Conservation Areas should be prohibited which should include Tredenham Road and he does not think that beach areas should be exempt from consent.

 

(ii) To further consider introducing a Policy on trading in Conservation Areas

Trading in a Conservation Area and AONB is not something the Parish Council wants to build upon and would need the opinion of local residents and businesses and professional advice if it were to bring in a policy.

 

11b. Affordable Housing

To consider updates on Affordable Housing matter – Nothing new to report

To consider the quotations for the printing of the Map and St. Mawes & the Roseland Guide

Cllr. Giles proposed to approve the quotations for the printing of the Map for £1,196.00 and the Roseland Guide for £1,274.00. Seconded by Cllr. Williams. All in favour by a show of hands. RESOLVED by the Council.

To further consider the proposals for the Parish Council Website

Cllrs. Sadler and Warren have had a very constructive meeting. A report will be given at the next meeting.

 

  1. Cleansing of the Parish
  2. a)   To consider the feedback from the working group – An update was circulated and the next meeting is arranged for Monday 9th November

 

  1. b)   To further consider Cornwall Council’s waste Reduction Incentive Scheme Trial – The deadline for the application to participate for which a grant is available is 20th November 2015. This is in hand.

 

  1. c)  To consider additional clearance of weeds in the Parish – Cllr. Salter suggested communicating with the Cleaning Operative initially and receiving his feedback on the situation.

 

  1. d)  To reconsider the cleaning of Bohella Store – The Clerk to place an advertisement in the Parish Magazine for the annual cleansing of Bohella Store.

 

  1. St Mawes County Primary School

To receive feedback from the meeting held on 27th October 2015 re the options for its future

Cllr. Black reported that St. Mawes County Primary School has decided to decline the offer to join the Multi Academy Trust (MAT). There is currently lack of evidence of an improved outcome for children. The decision can be reviewed in a year to see how the MAT has progressed in that time. The Parish Council is very passionate that the school remains at the heart of its community and will continue to support acceptable Affordable Housing Schemes.

 

  1. Footpath Maintenance

To approve the lopping of the trees in front of Brooklyn Terrace/boundary with the footpath

Cllr. Giles proposed to approve the lopping of the trees on the boundary of the permissive footpath. Seconded by Cllr. Warren. All in favour by a show of hands. RESOLVED by the Council.

  1. Date of next meeting – The next Parish Council meeting will be held on Monday 7th December 2015 at the Parish Millennium Rooms, St Mawes commencing at 7pm.

 

There being no further business, the meeting closed at 9.45pm

 

At the end of the meeting, to mark the landmark forty years as a respected member of the Parish Council, four times as Chairman, Cllr. Phil Salter was presented with a specially designed commemorative cup depicting the council’s emblem and the words ‘in recognition and appreciation of 40 years of exceptional service to the community’ by the Chairman. Cllr. Chenoweth spoke of the Parish Council’s gratitude to Cllr. Salter who has worked tirelessly as a member, also serving on associated committees such as Finance, Planning, Car Parks and Millennium Rooms and undertaking maintenance work without payment.
