Minutes of the Parish Council Meeting held at the Mevagissey Activity Centre
On Thursday 23 November 2017 at 7pm.
Present Cllrs. M Roberts (Chairman), J Blackmore, J Daniel, M Facey, H Nathan, G Shephard, J Whatty.

- Apologies were received from Cllrs. K Robinson, J Morgan, T Barron and Julian Barron.
Proposed by Cllr. Facey, Seconded by Cllr. Nathan that Cllr. Florence’s reason for absence be approved by the Council. Carried.
- Cllr. Daniel declared an interest in agenda item 9g (planning application for Curlews).
- A police report was received for the period 17/10/17-19/11/17 detailing a total of 8 reported crimes: 1 x burglary (male broke into a hotel causing damage, but nothing taken); 1 x theft of jewellery from shop; 2 x harassment (domestic incidents); 4 x criminal damage (3 incidents in local car park, with damage to 2 cars and a wall; and an incident where trees in a private garden have been cut back without the owner’s permission). During the same period last year there were 3 crimes.
- Public Participation.
Mr Sam Mayou, Heritage Consultant with CAD Architects of Truro, spoke on agenda item 9h, describing how the changes they were proposing at Chapel Point House were focussed on removing some of the insensitive features which have been introduced in recent years, while retaining the available habitable space. He answered questions from Councillors and intends to keep the Council updated with progress.
Mr Gary Farr of GCF Services spoke on agenda item 16, suggesting improvements to the operation of the public conveniences next year.
- Proposed by Cllr. Shephard, Seconded by Cllr. Daniel that the minutes of the meeting held on 19 October 2017 be accepted. Carried.
- The Clerk reported that:
- The Football Club has had to pay to rectify damage caused by Cormac while cutting the grass, and has asked whether a different supplier can be engaged next year. Quotes are awaited;
- CC have notified the amount they propose recharging following the contested election in May;
- CC Highways have agreed to remove the redundant lifesaving equipment at Mitchell’s Boatyard following a complaint about its condition;
- All Councillors have been invited by the school to the dress rehearsal of the Starfish and Dolphin classes’ Christmas play, starting at 10am on Tuesday 12 December.
- The Ward Member reported that:
- The Community Action Group had been recognised at the Cormac Cornwall Community Award Celebrations;
- Cormac are securing the storage building at Trewinney Cemetery following vandalism, and will be tidying the path between Trevarth and Valley Road;
- The speed test results on Tregoney Hill were within the limit; results for Valley Road are awaited;
- He has received an assurance that the road closure on Polkirt Hill on 15-17 January will be lifted in the event of tidal cut-off at Portmellon Cove;
- BT has finally removed the redundant phone box from the Rising Sun car park;
- He has continued to flag up complaints about the temporary traffic lights on School Hill.
- He was keen to draw the attention of local businesses to the Final Straw campaign to replace single-use straws with fully biodegradable ones, and invited those interested to contact him for details.
- Correspondence received:
- Letter from Cllr. Geoff Brown (CC Cabinet Member for Transport) requesting a preferred date for pre-Christmas free parking in the village (this was agreed for Saturday 2nd December to coincide with the Christmas lights switch-on);
- Letter from Lynne Behenna requesting support for the Christmas Window Trail. (agenda item 21).
- Letter from the Post Office regarding the new service at Mevagissey News from 8th December.

9a. PA17/08915 : Erection of shed/summerhouse, garden tool store and glass canopy over front door. Compass Point Polkirt Hill Mevagissey St Austell Cornwall PL26 6UX
Proposed by Cllr. Shephard, Seconded by Cllr. Facey that the Council makes no objection. Carried.
9b. PA17/08905 : Change of use of existing holiday letting unit to unrestricted residential use. The Barn Treleaven Farm Valley Road Mevagissey PL26 6SA
Proposed by Cllr. Daniel, Seconded by Cllr. Shephard that the Council makes no objection. Carried.
9c. PA17/10459 : Non-material amendment (1) for correction of dimensions on approved drawings and minor modifications to fenestration and roof form following a re-evaluation of space in respect of Decision Notice PA17/00735 – demolish existing dwelling and garage, construct new dwelling, new garage and associated exterior landscaping works. Longpoint Chapel Point Lane Portmellon Mevagissey PL26 6PP
Proposed by Cllr. Facey, Seconded by Cllr. Shephard that the Council supports the application. Carried.
9d. PA17/09354 : Listed Building Consent to replace wooden porch structure with a new timber structure. 25 Tregoney Hill Mevagissey PL26 6RE. Proposed by Cllr. Facey, Seconded by Cllr. Shephard that the Council supports the application subject to the recommendations of the Conservation Officer. Carried.
9e. PA17/08395 : Demolition of existing Garage/ Workshop and single storey extension and construction of double and single storey extensions incorporating new garage. Nampara Penwarne Lane Mevagissey PL26 6PF
Proposed by Cllr. Daniel, Seconded by Cllr. Shephard that the Council supports the amended plans. Carried.
9f. PA17/09865 : Removal of condition 4 in respect of decision 89/22/01320 (erection of 16 houses) to allow replacement of windows with PVC. 6 Polkirt Heights Mevagissey PL26 6TT.
Proposed by Cllr. Daniel, Seconded by Cllr. Whatty that the Council makes no objection. Amendment proposed by Cllr. Facey, Seconded by Cllr. Whatty, and Carried, that this should be conditional on the replacement windows maintaining the existing style. Substantive Motion carried.
9g. PA17/10758 : Adjustment to the roof at the front of the building and reduction in some window sizes. Curlews Penwarne Lane Mevagissey PL26 6PF. Cllr. Daniel, having declared an interest, left the meeting for this item.
Proposed by Cllr. Shephard, Seconded by Cllr. Facey that the Council, having watched successive applications for this property moving incrementally closer to the original proposal which was refused in April of this year, and deciding that enough is enough, should Object to this application. Carried.
9h. PA17/02809/PREAPP : Pre application advice for alterations and extension to existing. Chapel Point House Chapel Point Lane Portmellon Mevagissey St Austell Cornwall PL26 6PR Noted.
9i. PA17/02815/PREAPP : Pre-application advice to replace existing building which is an eye sore in the setting of prominent listed building with a modest 2-bedroom dwelling. Penwarne Manor Penwarne Lane Mevagissey St Austell Cornwall PL26 6PQ Noted.
9j. PA17/03052/PREAPP : Pre-application advice for a smoking shelter in pub beer garden. The Cellar Bar St Georges Square Mevagissey St Austell Cornwall PL26 6UB Noted.
9k. PA17/03136/PREAPP : Pre-application advice for replacement of existing lattice mast with a new lattice mast, together with revised compound and fencing. Communications Station Ntl 13126 Higher Well Park Mevagissey Cornwall. The applicant had asked for the Council’s views on their proposals, and the Council recognised that improved communications would be of benefit to the village.

9m. The following Planning Enforcement cases have been notified (included for information only):
EN17/02073 : Alleged installation of solar panels in a conservation area. Land South Of 1 Battery Terrace.
EN17/02200 : Alleged unauthorised works to Grade II Listed Building – removal of staircase and kitchen, increase in size of first floor, increase in boundaries of car port, fence moved and trellis added. The Gig House, Elm Terrace.
9n. The Chairman reported from the last meeting of the Planning Partnership:
- The Local Planning Authority (LPA) wants to institute a process, ‘Post Decision Community Engagement’, whereby communities are kept updated on the progress of larger applications during the build phase;
- The revised guidance for Pre-Applications is being evaluated.
- To approve the monthly finances.

The addition of the training course fee, not on the agenda, was noted.
Proposed by Cllr. Shephard, Seconded by Cllr. Nathan that the accounts be accepted and the bills paid. Carried.
- Proposed by Cllr. Shephard, Seconded by Cllr. Facey, that the draft budget for Financial Year 2018/19 be agreed and accepted. Carried.
- Proposed by Cllr. Shephard, Seconded by Cllr. Facey that the Precept for Financial Year 2018/19 should remain unchanged. Carried.
- Cllr. Shephard reported that the statutory consultation period for the Neighbourhood Development Plan (NDP) had ended two weeks ago, and that he was awaiting confirmation that the appointed inspector had started work.
- Proposed by Cllr. Facey, Seconded by Cllr. Whatty that 1) any development on an exception site should provide for as near 100{c8c3b3d140ed11cb7662417ff7b2dc686ffa9c2daf0848ac14f76e68f36d0c20} affordable properties as possible; 2) affordable homes should be valued such that they are truly affordable (in terms of local income) and available as affordable homes in perpetuity, whether rented or part-purchase; and 3) any development on an exception site should be ‘minor’ as defined by Cornwall Council Development Types and Definitions, Minor Developments – Definition, page 6, ie where the number of dwellings to be constructed is between 1 and 9 inclusive (where the number of dwellings to be constructed is not given in the application, a site area of less than 0.5 hectares should be used). Carried.
- To consider current affordable housing issues within the Parish. Proposed by Cllr. Facey, Seconded by Cllr. Daniel that this item be moved to the end of the meeting and held in closed session. Carried.
- Cllr. Facey reported that low level theft and vandalism was continuing at the Valley Road public conveniences.
- Proposed by Cllr. Whatty, Seconded by Cllr. Shephard that the quotations received from GCF Services to operate the public conveniences during the Financial Year 2017/18 be accepted. Carried.
It was agreed that the Council was very satisfied with the service provided by GCF Services during the past year.
- To approve funding for the installation of a soakaway outside Valley Rd PC and repairs to floor inside. Cllr. Facey asked for this to be deferred to the next meeting.
- Proposed by Cllr. Whatty, Seconded by Cllr. Nathan that the Council agreed that St Peter’s Church should be allowed to erect a wooden nativity crib next to the Christmas tree in St George’s Square by the war memorial (as in previous years). Carried.
- To consider a proposal to improve signage for places of interest within the village (Cllr. Blackmore).
This item was deferred to the next meeting.
- Proposed by Cllr. Daniel, Seconded by Cllr. Shephard, that a grant of £150 be made to “The Mevagissey Christmas Window Trail’. Carried.
- There were two applicants for the Councillor vacancy following the resignation of Dawn Speed and, following a ballot, Jon Gann was co-opted to the Council.
- The meeting was held in closed session from this point, while current affordable housing issues were discussed.
Proposed by Cllr. Daniel, Seconded by Cllr. Facey that the position of the Council, in responding to requests for an official view on development proposals, should refer the developer to the resolution stated in Minute no. 14 above.
