Minutes of the Parish Council Meeting held at the Mevagissey Activity Centre
On Thursday 24 January 2019 at 7pm.
Present Cllrs. M Roberts (Chairman), J Daniel, M Facey, N Florence, J Gann, H Nathan, G Shephard, P Simpson, J Whatty.
In Attendance Cllr. J Mustoe (Ward Member), Carol Baines, P Howson (Clerk), 6 members of the public.

- The Chairman opened the meeting by wishing everybody a Happy New Year.
Apologies were received from Cllrs. T Barron, J Blackmore, J Morgan and K Robinson.
Proposed by Cllr. Daniel, Seconded by Cllr. Shephard that Cllr. Robinson’s reason for persistent absence should be approved. Carried.
- Cllr. Daniel declared an interest in agenda item 8a. Cllr Facey declared an interest in agenda item 18.
- Carol Baines presented details of the Befriending Scheme she is setting up for Mevagissey and the surrounding area because of the high number of single elderly people here. She has been offered free use of St Andrew’s Church hall, and Age UK of Cornwall have offered free DBS (Disclosure and Barring Service) checks and volunteer training. Anybody interested in the scheme, either as a volunteer or as a beneficiary, should contact Carol on 07445 319990.
- Public participation. Laura Ludman spoke on agenda item 8a, presenting her proposal to sub-divide the curtilage of 5A Church Lane and build a new dwelling with access from School Hill; and Peter Bowker, the architect, addressed objections to the proposal which had been raised by a neighbour. Allison Foard spoke on agenda item 8b, urging the Council to object to the proposed major development on Vicarage Hill.
- Proposed by Cllr. Daniel, Seconded by Cllr. Facey that the minutes of the meeting held on 20 December be accepted. Carried.
- The Clerk reported that:
- The police website shows 7 crimes reported in November as follows: 4 x anti-social behaviour (in Valley Road car park, Valley Park Lane, West Wharf and Chapel Street); 1 x violence and sexual offences (in School Hill, under investigation); 1 x public order (in Chapel Square, unable to prosecute suspect); 1 x shoplifting (in Fore Street, investigation complete, no suspect identified);
- Update on provision of accessible defibrillator deferred until Cllr. Morgan’s return next month;
- Letter received from the Police and Crime Commissioner inviting feedback to the proposal for an increase to the police precept of £24 per annum to Band D council tax;
- Reply received from CC to my letter proposing a joint approach to planning enforcement;
- Email received from Lynne Behennah thanking the Council for its donation to ‘Mevagisseymas’;
- Email received from CC’s regarding the Area Team Planning project which has an implementation date of 1 April. There will be a presentation at the St Austell Council Chamber on 21 March from 5pm to 6.30pm.
- The Ward Member presented his report, including that:
- He is pressing CC to assume maintenance responsibilities for a disputed piece of land on the The Cliff above East Wharf toilets;
- The proposed double yellow line schemes for School Hill, Bodrugan Hill and Portmellon Park will be included in the area traffic regulation order later this year, which will include public consultation;
- Cormac have agreed to de-clutter the confusing signs regarding Speed Limit near the junction of Church Street and Church Lane;
- He will shortly be restarting the community gardening and beach clean/litter pick schedule for the year – let him know if you want anywhere considered or want to join in;
- He completed the Scrooge Mud Run for Children’s Hospice South West on 23 December and has to date raised over £1,300. He thanked those on the Parish Council who sponsored him as well as everyone else who either donated online or via Boots in the village.

8a. PA18/11627 : Proposed detached dwelling for a dependant relative. Land East Of 5A Church Lane School Hill Mevagissey Cornwall PL26 6TQ. Proposed by Cllr. Shephard, seconded by Cllr. Whatty that the Council has no objection to the proposal, but that a Construction Traffic Management Plan should be provided. Carried.
8b. PA18/09651 : Residential development comprising 26 units (revised plans). Land At Vicarage Hill Mevagissey
Proposed by Cllr. Florence, Seconded by Cllr/. Gann that the Council stands by its previous Objection, supported by NDP Policy EG1 (Coastal and Landscape Protection) with particular reference to the need to avoid elevated locations such as ridgelines. Carried.
8c. PA18/09823 : Proposal for a replacement low-energy architect designed dwelling (decision PA17/11678) with variation of condition 6 to allow change of external wall finish. Former Seapoint House Hotel Battery Terrace Mevagissey PL26 6QS TO RESPOND TO 5-DAY PROTOCOL LETTER
Proposed by Cllr. Florence, Seconded by Cllr. Gann that the Council stands by its Objection and that the Ward Member should be asked to call it in to committee. Carried.
8d. PA17/11588 : Construction of a detached dwellinghouse and garage. Land North Of 22 Portmellon Park.
An Appeal against Refusal has been made. Noted.
8e. The following planning decisions have been received (included for information only):
PA18/06484 : Demolition of existing flat roof garage and construction of four bedroom dwelling. Land East Of Seaforth Trevarth. APPROVED
PA18/06592 : Change of use from Car Park to mixed use to provide car parking, onsite food and takeaway outlet, a kayak/paddle board store – hire and retail sales, a public disabled unisex wc with shower and changing facilities, boat storage only during winter months and associated facilities during summer months. Car Park Adj To The Rising Sun Inn Portmellon. APPROVED
PA18/06586 : Outline application with some matters reserved for erection of one detached house. Park Cottage Portmellon. REFUSED

8f. Cllr. Roberts provided an update from the last meeting of the Planning Partnership, including:
- Details of the Area Team Planning project;
- Progress on development of the ‘Post-PACE’ process, whereby planning case officers will monitor approved schemes to ensure compliance with planning conditions;
- Consideration being given to the granting of a ‘right of reply’ following speeches by planning agents at planning committees.
8g. Following recent planning decisions, it was Proposed by Cllr. Florence, Seconded by Cllr. Simpson that Cllr. Shephard should write to CC requesting that the Neighbourhood Development Plan be amended to make it clear that ‘local’ meant ‘local to Mevagissey’.

Proposed by Cllr. Shephard, Seconded by Cllr. Facey that the accounts be accepted and bills paid. Carried.
- Proposed by Cllr. Facey, Seconded by Cllr. Shephard that the January 2019 version of Standing Orders be adopted by the Council. Carried.
- Cllr. Gann provided an update on the proposed Community Land Trust.
- Cllr. Facey reported that the new soakaway created by the Valley Road public conveniences appears to have solved the problem of flooding in the Ladies; and that the door to the disabled facility at West Wharf requires re-fixing.
- In Cllr. Blackmore’s absence, an update on the memorial to mark the mass graves of the 1849 cholera victims was deferred.
- Proposed by Cllr. Facey, Seconded by Cllr. Whatty that a donation of £500 be made to the Mevagissey Christmas Lights Committee. Carried.
Cllr. Mustoe said that he would contribute £250 from his Community Chest funds.
- Proposed by Cllr. Florence, Seconded by Cllr. Gann that the Council was unable to consider a request for support from the Cornwall Partnership Foundation Trust’s Sowenna Appeal. Carried.
- The Council considered changes suggested by the Cornwall Community Governance Review.
Proposed by Cllr. Facey, Seconded by Cllr. Florence that the Civil Parish boundary remains unchanged. Carried.
Proposed by Cllr. Florence, Seconded by Cllr. Whatty that the name of the Council remains unchanged. Carried.
- It was agreed that the Clerk should write to CC in support of the Harbour Trustees regarding the cliff wall on East Wharf and expressing concern at this possible danger to the public.
- The Council considered CC’s proposed 2019 Off-Street Parking Order. Proposed by Cllr. Whatty, Seconded by Cllr Nathan that the cost of parking for up to 30 minutes at the River Street car park should be reduced to 20p. Carried.
- The meeting ended at 9.40pm. Date of next meeting: 21 February 2019.
