Minutes of the Parish Council Meeting held at the Mevagissey Activity Centre
On Thursday 18 October 2018 at 7pm.
Present Cllrs. M Roberts (Chairman), J Blackmore, J Daniel, J Gann, J Morgan, H Nathan, G Shephard, J Whatty.
In Attendance Jeremy Roberts and Heidi Clemo (Three Bays Wildlife Group), Cllr. J Mustoe (Ward Member),

- Apologies were received from Cllrs. J Barron, K Robinson and M Facey.
- There were no Declarations.
- Jeremy Roberts and Heidi Clemo of the Three Bays Wildlife Group introduced themselves, presented the work of the Group and answered questions put by members of the Council and the public. Mr Roberts is also Vice-Chairman of the Mevagissey Museum, and he spoke briefly on agenda item 15 (the 1849 cholera epidemic).
- Public participation.
Jane Barron spoke on agenda item 8b, objecting to the proposal. Because this item is being deferred pending receipt of further revised plans, others who had intended to speak agreed to await the plans.
Roger Overell, Chris Gardiner, Sarah Vercoe, Phil Simpson and Peter Hingley spoke on agenda item 8a, objecting to the development of the Portmellon car park.
Phil Simpson also spoke on agenda item 13, questioning whether the cost involved would justify the benefit.
Alex Williams spoke on agenda item 8a, supporting the development of the Portmellon car park and noting that the proposed provision for motorhomes had been removed in response to objections.
- Proposed by Cllr. Shephard, Seconded by Cllr. Daniel that the minutes of the meeting held on 20 September be accepted. Carried.
6a. The Clerk reported that:
- The police website shows 9 crimes reported in August as follows: 1 x violence and sexual offences (School Hill, investigation complete, no suspect identified); 1 x other theft (West Wharf, under investigation); 7 x anti-social behaviour (various places around the parish);
- Cornwall Council have offered a free day’s parking in their car parks, and we have requested Saturday 1st December, which is when the Christmas lights are being switched on;
- CC were asked to confirm whether Conditions 8 and 9 of Appeal Decision APP/D0840/W/15/3139301 (allowing the appeal against refusal of application PA15/ 03079) had been complied with (minute 2018/07/10a refers), and they have now replied that because there was no time limit imposed on the completion of the proposed works or on the discharge of conditions, they are not subject to planning enforcement;
- The Environment Agency were asked to consider giving the Portmellon flood plain ‘designated’ status (minute 2018/09/19 refers) and they have replied that only ‘main rivers’ can be designated, and the Portmellon stream does not fall within this category;
- Helen Blamey, St Andrew’s Church Secretary, has invited all Council members to the 11am service on Sunday 17 February, which will be led by the Revd Steve Wild, Chair of the Cornwall Methodist District, & Bala Gnanapragasam, Vice-President of the Methodist Conference, to be followed by lunch in the church hall.
- Gilbert & Goode have submitted a planning application for the site at the top of Vicarage Hill which will be on the November agenda and Jo Harley (G&G) will attend to present the plans and answer questions.
6b. Cllr. Roberts reported that the most recent Community Network Panel included a presentation on Cornwall Council’s Warm & Well initiative. Cllr. Morgan is involved with this and will give a presentation at the next meeting.
- The Ward Member presented his report, including that:
- He visited Mevagissey School and Little Nippers to discuss plans and offer help;
- He visited Portmellon residents to progress alleged breaches of planning;
- He is supporting a cross-party motion to revisit Cornwall Council’s interpretation of how GDPR applies to planning and enforcement;
- He offered full support for Sarah Hunkin’s proposed ceramic poppy installation in the war memorial garden, and will be working there ahead of Remembrance Day;
- He progressed the clearance of trees and branches fallen in the recent storm;
- He arranged for South West Water to fix a leak in Wesley Court;
- He announced a Harbour Clean on Wednesday 24 October at 12 noon on the Jetty.

8a. PA18/06592 : Change of use from Car Park to mixed use to provide car parking, onsite food and takeaway outlet, a kayak/paddle board store – hire and retail sales, a public disabled unisex wc with shower and changing facilities, boat storage during winter months and associated facilities during summer months. Car Park Adj To The Rising Sun Inn Portmellon Mevagissey Cornwall PL26 6PL (Deferred again from last meeting).
Proposed by Cllr. Whatty, Seconded by Cllr. Nathan that the Council would have no objection to the proposals conditional on strict compliance with the submitted Management Plan which must be enforceable. Carried.
8b. PA18/06484 : Demolition of existing flat roof garage and construction of four bedroom dwelling (revised plans). Land East Of Seaforth Trevarth Mevagissey Cornwall PL26 6RY
The planning officer thinks that the proposed dwelling would still be too large for the plot and has asked for further changes. These will be considered at the November meeting.
8c. PA18/08553 : Construction of a terrace of three houses and a detached one and a half storey house and all associated works. Land Adjacent 38 Kiln Close Mevagissey PL26 6TP
Proposed by Cllr. Shephard, Seconded by Cllr. Whatty that the Council supports the proposal on the following conditions: 1) No development shall begin until a Construction Traffic Management Plan has been submitted for review by the Parish Council prior to approval by the LPA; 2) No additional openings in the North Western and South Eastern (side) elevations shall be constructed without the express written consent of the LPA; 3) The LPA will attach further conditions to any approval to match those imposed on the approval for the previous application on this site (PA13/02115). Carried.
8d. PA18/09538 : Retrospective Listed Building consent for the repair of a wall using materials similar to the original. The door has been replaced with one of similar appearance. 26 Polkirt Hill Mevagissey Cornwall PL26 6UR
Proposed by Cllr. Gann, Seconded by Cllr. Whatty that the Council has no objection. Carried.
8e. The following planning applications have been Approved (included for information only):
PA18/07670 : Single storey rear extension and decked area. 9 Higher Lavorrick; PA18/07929 : Proposed extensions and balcony. East Paddock School Hill; PA18/04406 : Change of use of managers accommodation to unfettered dwelling. Trevalsa Court (with conditions including removal of permitted development rights and principal home restriction);
PA18/06753 : Demolition and Proposed replacement dwelling. 29 The Cliff (with conditions including Construction Traffic Management Plan and removal of permitted development rights including additions or alterations to the roof);
PA18/05405 : First floor extension to front and rear and change of roof. Curlews Penwarne Lane;
PA18/07234 : Self contained annexe (amendment to PA17/01137). Pondokie School Hill (with conditions including occupation restricted to family and non-paying guests);
PA18/06597 : Installation of a garden annex. The Headlands School Hill (with conditions including occupation restricted to family and non-paying guests).
8f. PA18/03040 : Reduction in roof height level enabled by the removal of the small pitch roof on the front elevation, addition of external wall insulation including Larch cladding to first floor external walls and various other alterations. Curlews Penwarne Lane Mevagissey PL26 6PF APPEAL AGAINST REFUSAL (for information only). Noted.
8g. To consider a response to a 5-day protocol letter received for PA18/07894 : Removal of a self-contained annexe and erection of a new dwelling house with associated parking at Sunny Croft, Ava. The planning officer had previously said that this would not be supported and this Council objected.
Proposed by Cllr. Morgan, Seconded by Cllr. Blackmore that the Council maintains its objection. Carried.
The Ward Member will call it in to the planning committee for a decision.

The addition of the waste collection and training costs, not on the agenda, was noted.
Proposed by Cllr. Shephard, Seconded by Cllr. Gann that the accounts be accepted and bills paid. Carried.
- Cllr. Gann gave an update on the proposed Community Land Trust (CLT). A Housing Working Group is being formed under the umbrella of the Cornwall CLT to drive the move towards a Mevagissey CLT. A public meeting will be arranged to engage people who have something to offer. Promotional materials will be required for this.
Proposed by Cllr. Shephard, Seconded by Cllr. Morgan that the costs of promotion of the CLT be authorised up to a limit of £1,000 (One Thousand Pounds). Carried.
- No issues arising from the operation of the public conveniences were raised.
- Proposed by Cllr. Whatty, Seconded by Cllr. Daniel that £200 be donated to Seafarers UK for Merchant Navy Day. Carried.
- Proposal to fund at least one ‘#2minutelitterpick’ board in the village. Deferred to next meeting.
- Proposal to provide a defibrillator at an outside location accessible 24/7 (Cllr. Roberts). Deferred to next meeting.
- A memorial to mark the mass graves of the 1849 cholera victims (Cllr. Blackmore). Deferred to next meeting.
- Proposed by Cllr. Whatty, Seconded by Cllr. Gann that £200 be donated to the North Coast Cluster Group’s ‘fighting fund’ for their proposed Judicial Review. Carried.
- The following highways schemes were proposed for consideration in future years under the Community Networks Highways Scheme: 1) a mirror at the bottom of Tregoney Hill; 2) a sign by The Ship Inn instructing south-bound traffic to ‘give way to approaching vehicles’; 3) a white arrow on the road in St Georges Square indicating the left turn for the harbour.
- Proposed by Cllr. Daniel, Seconded by Cllr. Whatty that £100 be donated to Little Nippers towards children’s presents for the Christmas Party. Carried.
- Proposed by Cllr. Whatty, Seconded by Cllr. Morgan that the Council fully supports Sarah Hunkin’s ceramic poppies project and authorises the use of the War Memorial garden accordingly. Carried.
- Proposed by Cllr. Daniel, Seconded by Cllr. Whatty that £500 be donated to Cornwall Hospice Care. Carried.
